Services 

The main purpose for which MARKCOM processes your personal data is to provide you with those services derived from any service contract you enter into with us; any services related to the use of applications, telecommunication services, software, websites and functionalities of your terminal equipment and/or any other services you voluntarily decide to acquire (hereinafter and collectively referred to as the "Services"). 

Categories of Personal Data Subject to Processing

MARKCOM will process the following categories of personal data: 

- Identification and Authentication DataName, surname, date of birth, autograph signature, official identification. 

- Contact InformationAddress, telephone, e-mail. 

- Equity and/or Financial DataCredit or debit card information, bank accounts. 

- Tax DataRFC, tax domicile. 

- Demographic DataAge, gender, occupation. 

- Device Location DataReal-time geolocation. 

- Network and Traffic DataIP addresses, device type, internet service provider. 

- Preference DataBrowsing history, application usage, interests. 

Sensitive Personal Data 

MARKCOM may process biometric data concerning your fingerprints and voiceprint in order to identify you and prove your identity for the provision of the Services and future transactions that you perform with us. 

Indirect Sources of Obtaining Personal Data 

In those cases where MARKCOM has a legitimate basis, it may obtain information about you from the following sources: 

- Affiliates and SubsidiariesFor purposes of this Notice, "affiliate" means any company that, directly or indirectly, controls, is controlled by or is under common control with MARKCOM. 

- Third Parties with Commercial AgreementsCredit information companies, financial institutions. 

- Public Access SourcesTelephone directories, public records, social networks. 

Obtaining information from these sources helps us to improve the Services we provide to you and to fulfill the primary and secondary purposes set forth in this Privacy Notice. 

Personal Data of Third Parties and Minors 

MARKCOM may process personal identification and contact data of third parties when you provide us with this information so that such third parties may be contacted in their capacity as personal references, for collection purposes and/or to conduct periodic investigations and monitoring of your credit history. By providing this information, you acknowledge that you have informed such third parties about the use of your data and have obtained their prior consent so that MARKCOM can treat them for the aforementioned purposes. 

MARKCOM does not collect information directly from minors. If necessary, such information must be provided by a parent, guardian or custodian. If we identify that a minor has provided information without proper consent, we will delete such information. 

Purposes of Processing 

Primary Purposes 

MARKCOM will process your personal data to carry out any or all of the following activities necessary for the development and fulfillment of the obligations arising and deriving from the Services: 

- Identity VerificationVerify your identity according to our procedures and policies, including the verification of your data before the National Electoral Institute (INE). 

- CommunicationContacting you via phone calls, emails, SMS messages and other means for matters related to the use and management of the Services, as well as to inform you about benefits or promotions. 

- Referral and Collection ManagementContact you and your references to validate the information provided and make collection efforts. 

- Analysis and StudiesTo prepare analyses and studies related to your consumer behavior and to conduct periodic research and monitoring of your credit history, including providing information to credit bureaus. 

- Billing and Payments: Perform billing activities and process payments related to the use of the Services and/or goods and services provided by third parties. 

- Service ManagementTo carry out activities related to the registration, cancellation, change and portability of Services, equipment and plans in accordance with the terms of use. 

- Network and Service SecurityMaintain the security of our networks and services, detect technical failures or errors, and ensure the proper provision of the service. 

- Legal Compliance: Attend and follow up on investigations and requirements of competent authorities, and comply with applicable legal obligations. 

Secondary Purposes 

MARKCOM will process your personal data for the following secondary purposes: 

- Promotions and OffersTo inform you about the launching or changes of new products, services, promotions and offers from MARKCOM, as well as from other companies of the group and commercial partners. 

- Data Profiling and AnalysisTo perform data analysis for profiling activities and to send you advertising, promotional and/or informational information that may be of interest to you. 

- Generation of Consumption ProfilesTo generate profiles and consumption habits so that our commercial partners can contact you and offer you products and services that they consider of interest to you.

Your consent will remain valid even after the termination of the legal relationship, unless you tell us otherwise. 

Transfers of Personal Data 

Transfers Not Requiring Your Consent 

MARKCOM may transfer your personal data without requiring your consent in the following cases: 

- Competent AuthoritiesTo governmental and judicial authorities in the cases legally foreseen. 

- National Electoral Institute (INE)For identity validation and authentication purposes. 

- Credit Information CompaniesTo verify your credit history and guarantee the fulfillment of obligations derived from the Services. 

- Group companiesFor promotional activities and offering of products and services, operating under privacy policies that comply with applicable regulations. 

- Authorized Third PartiesTo third parties that you authorize to provide information related to the Services. 

Transfers Requiring Your Consent 

With your consent, MARKCOM may transfer your personal data to: 

- Business Partners and Third PartiesTo enable them to contact you and offer you goods and services of interest to you, or to determine if you are eligible to purchase the goods and services they offer.

ARCO Rights and Revocation of Consent 

You or your legal representative may exercise your rights of Access, Rectification, Cancellation or Opposition (ARCO Rights), as well as revoke your consent for the processing of your personal data, by sending a request to MARKCOM's Personal Data Department at the following e-mail address datospersonales@markcom.com.mx. 

Procedure to Exercise Your Rights 

- Download FormObtain the "Single Form for the Exercise of ARCO Rights, Revocation of Consent and/or Limitation of Use or Disclosure of Personal Data" available at https://markcom.com.mx/aviso-de-privacidad. 

- Complete the FormPlease provide the requested information and attach a copy of a valid official ID. 

- Submit ApplicationSend the form and documents to the following e-mail address datospersonales@markcom.com.mx. 

- Application AttentionIf the information is insufficient, we will ask you for additional data within the following time frame. 5 working days following. You will have 10 working days to respond. 

- ReplyWe will inform you of our decision within a maximum period of 20 working days from receipt of your request. If applicable, we will execute your request within 15 working days following. 

Choices and Means to Limit the Use or Disclosure of Your Personal Data 

You can limit the use or disclosure of your personal data by sending your request to MARKCOM's Personal Data Department at the following e-mail address datospersonales@markcom.com.mx. We will follow the same procedure described for exercising your ARCO Rights. 

If your request is successful, we will place you on our internal opt-out list so that you will no longer receive promotions from us.
